Ali Zafar’s legal battle with Ms Meesha Shafi has been going on for the past two years. In the latest turn of events, Mr Saqib Jillani, the counsel of Meesha Shafi, appeared on Meesha Shafi’s behalf and filed an application under section 151 CPC for stay of Ali Zafar’s defamation case on the ground that due to the registration of FIR witnesses can’t be produced.
Mr Saqib Jillani argued that Meesha’s witnesses are not ready to appear in court in this climate of harassment. Mr Jillani argued that one of Meesha’s witness Humza Raza has apologized from Ali Zafar for a statement under the pressure of FIR. Therefore, Ali Zafar’s defamation case should be stayed until the final decision of the FIR.
According to a report in Dawn and a report in The News, Meesha Shafi filed an application that said that the case is on the stage of recording of evidence and a false and frivolous FIR has been registered against her and eight others including four of her witnesses including Leena Ghani, Maham Javaid, Humna Raza and Iffat Omer.
Ali Zafar’s counsel Mr Umer Tariq Gill appeared on his behalf and opposed the contention of Meesha’s counsel. Mr Umer Tariq Gill argued that the application for stay of Ali Zafar’s Defamation case is not maintainable.

It was argued that Humza Raza was a private witness of Ms Meesha Shafi but Humna Raza refused to appear in court.
After her refusal, reported the counsel, Meesha requested the court to summon the witnesses through the process of the court.
Ali Zafar’s team raised no objection on Meesha’s request and in this behalf order was passed by the court with the consent of parties.
This was all done before registration of FIR and thus there is no question of harassment, said the counsel.

Moreover, 3 witnesses of Meesha Shafi (Meesha Shafi’s mother Saba Hamid, her husband Mehmood and her manager) are not nominated in FIR and the counsel said that these witnesses have not appeared for cross-examination.
Meesha Shafi’s counsel requested for adjournment of 10 days but Ali’s counsel argued that the reply to the application will be filed in 2 days so there is no need to adjourn the case for 10 days. The request of Ali’s counsel was accepted. The next hearing of the case is fixed for October 13, 2020.
